Welcome to xide.ca. This Website (the "Website") is owned and operated by Xide Technology Inc. ("Xide"). By accessing the Website, the user accepts and agrees to be bound by all of the terms and conditions (the "Terms") set out herein.
2. OWNERSHIP OF WEBSITE CONTENT, TRADEMARKS AND PATENTS
The Website and its Content, including the underlying HTML, text, illustrations, designs, images, photographs, icons, documents, software and all other website content, arecopyrighted protected works owned by us. Xide trademark(s) and logo(s) used in the Website are also owned by Xide. Xide may update or make changes to the Website and Content at any time without notice. Xide may apply for patents as it sees fit.
3. X-EMPIRICAL MODELLING AND GRANT OF LICENSE
Xide team invented X-EMPIRICAL MODELING ("XEM"), a key innovation in data analytics and experiments . The Content includes simulations, price forecasts, return assessments and risk assessments which are all generated by XEM.
Xide hereby grants you, the user, a royalty-free, non-exclusive and non-transferable license to view and display the Content on your computer or mobile device and to download and print all or any part of the Content. The Website user can choose to set up and sign in to an account or to be just a visitor for which no user account is required.Theforegoing license is subject to the following conditions:

In certain circumstances, access to a hypertext link of the Website may link to another website belonging to and operated by a third-party. Xide assumes no responsibility for the content of such third-party websites and we do not endorse, authorize, approve, certify, maintain or control these other websites and we do not guarantee their accuracy. You agree to access any third party website at your own risk.
5. USER ACCOUNT AND DATA COLLECTION AND PRIVACY
In order to access more information, features and functionalities, you are required to create an account by signing-up, and then signing-in to your account. You have to provide personal information such as your email, cell number, password, and sometimes user surveys(collectively called "Personal Information"). All Personal Information will be stored in our server. We will not release any of your Personal Information to a third party without your express consent. Your account is protected by a password. We may send you verification email(s) or texting message(s) from time to time which you agree to receive.
Xide may also collect additional information such as the internet protocol address of your service provider, your browser and platform type and the sections of the Website you visited or downloaded. This helps us to diagnose any server problems and improve our products and services. Xide may use cookies which you may disable if you prefer but which may cause some features to not operate properly.
6. REAL-TIME DATA
Raw data including real-time data, and daily or periodically updated data are provided by a third party (or parties), and may be delayed as specified by our data providers. Xide does not verify any data and disclaims any obligation to verify them.
Additionally, Xide expressly disclaims the accuracy, adequacy, or completeness of any data and shall not be liable for any errors, omissions or other defects in, delays or interruptions in such data, or for any actions taken in reliance thereon or for any damages relating to your use of the information provided herein.

7. SIMULATION, REAL-TIME WATCH, PRICE FORECAST, RETURN & RISK ASSESSMENT, MOMENTUM CALIBRATIONS, AND PORTFOLIO
Simulations are for model demonstrations, performance and result tests only, which are impersonal and are not tailored to the needs of any person or entity.
Real-time watch, price forecasts, return & risk assessments and momentum calibrations for equities shown in the Content are all automatically generated by our XEM modeling for your reference only. They are impersonal, and are not tailored to your needs. Xide is not an investor advisor. These real-time watches generated by XEM modeling in the Content, may not be suitable for you. None of real-time watches with relevant data and information constitute a recommendation by Xide to buy or sell any security, and Xide makes no representation regarding the advisability or suitability of any investment you may be engaged in. Actions indicated by "IN (Buy)" or "OUT (Sell)" in Real-time Watch sections are automatically generated by XEM model, and also recorded in XEM model's database for simulations, tracking and performance test purposes. These indicated actions are for user's reference only.
Equities' price forecasts, return & risk assessments and momentum calibrations in the Content may significantly differ from those made by other researchers or consultants.
In order to gain real-time experience for managing investment portfolio with real-time data, a user can build a hypothetical portfolio in the user's account under "my portfolio", practice equity buy or sell transactions in the portfolio, and monitor portfolio performances. Users must be aware that this is just a hypothetical, not a real portfolio.
8. USER REGISTRATION AND SERVICE FEES
If you have registered as a free-user or premium-user account with Xide, you are responsible for maintaining your confidentiality of log-in information and for restricting access. You are responsible for all activities that occur under your account. User privileges are personal and non-transferable. You represent and warrant that the information you provide in your account is complete, true and up-to-date.
Upon registration for a free-user account, you may view and access information up to 10 equities in your stock list/pool, for simulations, real-time watches, portfolio management, and comprehensive analytics. By upgrading to the premium user, you can add up to 50 equities in your stock pool. For any type of user account, at any time you can delete a stock from and add a new stock to your stock list/pool.
For a premium user, Xide charges a flat fee at $30.00 per month, payable monthly in advance on the first day of each month, or annually in advance at a reduced rate of $300.00 per annum. Xide reserves the right to change the fee amount by email notice to you.

YOUR USE OF THE WEBSITE IS ENTIRELY AT YOUR OWN RISK. THE WEBSITE AND CONTENT IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, XIDE DOES NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING ACCURACY OR RELIABILITY OF THE CONTENT OR YOUR USE OF THE WEBSITE TO MAKE INVESTMENT DECISIONS. You agree to defend, indemnify and hold harmless Xide, its employees, agents, officers and directors from and against any and all claims, damages, obligations, judgments, losses, liabilities, costs or debt, legal fees and other expenses made by a third party against Xide, its employees, agents, officers and directors,arising from your use of and access to the Website and the Content, or any sites linked to the Website. This clause 10 shall survive the expiration of the license.
11. PROHIBITED USES
You may not use the Website for any illegal or unauthorized purpose. You agree to comply with all applicable federal, provincial, state and local laws and regulations. You may not use the Website in any manner which could disable, overburden, damage or impair the Website, Xide's servers or computer network, or interfere with any other party's use and enjoyment of the Website.
12. LAW AND JURISDICTION
You agree that you have reached your age of majority and that you agree to abide by and comply with these Terms. These Terms shall be governed by the laws of the Province of British Columbia, Canada. You agree to submit to the jurisdiction of the courts located in Vancouver, British Columbia, Canada.
